Liability Waiver & Rental Agreement

 

This Liability Waiver and Rental Agreement (“Agreement”) is entered into between Scooter Town (“Company”) and the Renter (“Renter”), collectively referred to as “the Parties.”


1. Definitions

  • Company: Scooter Town, provider of mobility scooters and electric wheelchairs for rental.

  • Renter: The individual or organization renting the equipment from the Company.

  • Equipment: Mobility scooters, electric wheelchairs, or any other mobility devices provided by the Company.


2. Rental Terms and Conditions

  • The Renter agrees to use the Equipment responsibly and in accordance with all local laws and regulations.

  • The Equipment must not be operated under the influence of alcohol, drugs, or any impairing substances.

  • The Renter must not allow unauthorized persons to operate the Equipment.

  • The Renter agrees to return the Equipment in the same condition as when received, except for normal wear and tear.

  • The Renter acknowledges that the Equipment is not designed for off-road or extreme use and must be used on paved, designated pathways only.




3. Assumption of Risk

  • The Renter acknowledges that operating mobility scooters and electric wheelchairs involves inherent risks, including but not limited to falls, collisions, equipment malfunctions, or injuries.

  • The Renter voluntarily assumes all risks associated with the use of the Equipment and agrees to hold the Company harmless from any claims arising from such risks.


4. Waiver of Liability

  • The Renter expressly waives any and all claims against the Company, its owners, employees, and affiliates for any injuries, damages, losses, or liabilities arising from the use of the Equipment.

  • The Company shall not be held liable for any accidents, injuries, or damages resulting from misuse, negligence, or failure to follow proper operating instructions.


5. Insurance and Responsibility

  • The Renter understands that they are responsible for any damage, theft, or loss of the Equipment during the rental period.

  • The Renter agrees to pay for repairs or replacement costs if the Equipment is damaged, lost, or stolen while under their care.



6. Indemnification

  • The Renter agrees to indemnify and hold harmless the Company from any and all claims, liabilities, damages, or expenses (including legal fees) arising from:

  • Improper use of the Equipment.

  • Violation of local laws and regulations.

  • Accidents, injuries, or damages caused to third parties.


7. Return Policy

  • The Renter must return the Equipment at the agreed-upon time and location.

  • Late returns may incur additional fees.

  • Failure to return the Equipment may result in legal action and additional charges.


8. Cancellation and Early Return Policy

Cancellations:

  • Rentals canceled at least 24 hours in advance will receive a full refund.

  • Rentals canceled less than 24 hours before the scheduled start time will incur a one-night rental fee as a cancellation charge.




No-Show Policy:

  • If the Renter fails to show up on the agreed rental start date without prior notice, a one-night rental fee will be charged, and the reservation may be canceled without refund.

Early Return Policy:

  • If the Renter decides to return the Equipment earlier than the agreed rental period, no refunds will be issued for the unused rental days.


9. Safety Instructions

  • The Renter agrees to follow all safety guidelines and operating instructions provided by the Company.

  • Helmets and other safety equipment are strongly recommended while operating the Equipment.

  • The Renter must report any malfunctions or safety concerns immediately to the Company.


10. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of Spain, specifically in Madrid, and any disputes shall be resolved in the courts of Madrid.



11. Acknowledgment and Consent

By signing this Agreement, the Renter acknowledges that they have:

  • Read, understood, and agreed to all terms and conditions outlined in this document.

  • Been given the opportunity to ask questions and clarify any concerns.

  • Agreed to operate the Equipment at their own risk and accept full responsibility for its use.
